1 Scope and subject matter of the General Terms and Conditions
The website wybrand.ch operates an internet platform on which WineBarrel GmbH (hereinafter referred to as the provider) offers various consumer goods for sale to a large community of interested parties (hereinafter referred to as users, buyers or customers).

The user has the opportunity to purchase products.

The General Terms and Conditions apply to all services and products that are provided, delivered or sold by the provider to the user or buyer. Deviating regulations only apply if they have been expressly agreed in writing between the provider and the user.

Special or general contractual conditions that contradict these General Terms and Conditions will not be accepted by the Provider and will not be valid in the relationship between the Provider and the User.

2 Conclusion of contract
The contract between the user and the provider is concluded by submitting the order. The content and scope of the service are determined from these General Terms and Conditions or from any individual agreements.

3 Prices
Prices are in Swiss francs. The prices valid on the day the contract is concluded are decisive.

4 Services of the provider
The provider provides services that are carried out with the best of its ability. It makes a particular effort to provide correct descriptions of the products. Despite careful checking, it cannot be ruled out that some of the information provided may be incorrect. The provider acts to the best of its knowledge and accepts no liability for any incorrect descriptions.

The provider has the right at any time to change the type, scope, price, terms and conditions of purchase and purchase channels of the services it provides and to completely refuse to provide its services in the event of late payment or other breaches of duty.

The provider is entitled to monitor the behavior of users in connection with the use of the Internet platform. The provider reserves the right to adapt the Internet platform to technical innovations or to change it at any time due to other circumstances.

In principle, the Internet platform is available for 24 hours. However, the provider cannot guarantee a minimum level of availability. The provider expressly reserves the right to discontinue the Internet platform in whole or in part. No liability is accepted for any system errors.

5 Obligations of the user and use of the Internet platform
The user undertakes to pay the agreed fee. The user is obliged to take all precautions so that the provider can provide its services to the user. Depending on the circumstances, this may include providing the provider with appropriate information and documentation. By accepting these terms and conditions, the user also confirms that he or she is of legal age. When placing the first order, the buyer is instructed to send a copy of their ID in the order confirmation. Those who collect the goods themselves are also asked to show ID in the order confirmation. The provider reserves the right to check the user's age at any time.

The user is also obliged to keep the personal login data provided to him by the provider, in particular the password, secret and never to disclose it to a third party or make it accessible to them. The user is personally liable for any damage caused by failure to comply with this duty of care.

6 deliveries
The place of performance for deliveries is the registered office of the provider. The transport risk is transferred to the buyer when the goods are handed over to the post office or parcel service, to the forwarding agent or carrier, but at the latest when they leave the company building. The packaging and postage costs will be invoiced to the buyer. Packages are normally sent on Tuesdays by Swiss Post.

7 Delivery dates
Specific delivery dates have not been agreed. If specified, they are for guidance only. The customer is obliged to accept the delivered goods. Delivery and any subsequent deliveries are made worldwide. If the provider is unable to meet its delivery obligations due to operational disruptions, labor shortages, strikes, failure to deliver to its own suppliers, fire damage, armed conflicts, official orders, significant changes in currency conditions or as a result of force majeure, it is released from its obligation to perform.

The buyer can only claim damages for late or delayed delivery if the provider can be accused of intent or gross negligence. If the provider is obliged to pay damages, the amount of liability is limited to the net invoice value. Lost profits, consequential damages and damages to third parties will not be compensated.

8 Right of return
The customer has no right of return.

9 Invoicing, payment terms and default
Payment can be made via the offered e-payment providers, which are integrated online.

10 Warranty
Any warranty is completely excluded.

11 Liability
Liability for any indirect damages and consequential damages is completely excluded.

Liability for direct damages is limited to the sales price of the affected product. This limitation of liability does not apply to direct damages caused by gross negligence or intent.

The customer is obliged to report any damage to the provider immediately. Any liability for auxiliary persons is limited to the same extent.

12 Intellectual property rights
Any content of the services provided by the provider is protected by copyright. The use and payment of the services by the user does not result in the transfer of intellectual property rights.

13 Data protection
The provider takes all reasonable measures to protect the data stored by it. All personal information provided by the user is treated as strictly confidential and used only for the operation of the Internet platform. Only the most necessary data is transmitted to third parties if it is required to process the order or delivery. Access by third parties to data stored by the provider or one of the provider's contractual partners does not lead to liability on the part of the provider and its contractual partners.

The provider uses user data to fulfill the services offered in accordance with the contract and the law, to maintain the user relationship and to make offers.

The user fully agrees to the storage and use of his data by the provider. The user can prohibit the use and processing of his data for marketing purposes at any time.

14 Severability clause
Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the intended economic purpose of the invalid provision. The same applies to any regulatory gaps.

15 Applicable law, place of jurisdiction
These terms and conditions are subject to Swiss law. Unless mandatory legal provisions apply, the court at the provider's registered office has jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods is explicitly excluded.
